These Terms of Service (“Terms”) are a binding agreement between you (“Traveler”) and Adiga Travel LLC (“Adiga Travel,” “we,” “us,” or “our”), a Washington limited liability company at 401 Pine St, Suite 700, Seattle, WA 98101, for use of our website and travel agency services (the “Services”). By using the Services, requesting quotes, or paying for travel we arrange, you agree to these Terms and our Privacy Policy. If you act for a company, you represent authority to bind it. Travelers under eighteen (18) need a parent or guardian who accepts these Terms on their behalf.
1. Acceptance of Terms
Use of the Services means you accept the then-current Terms. We may update them by posting a revised version; material changes may also be emailed or noted at booking. Continued use after the effective date constitutes acceptance, except that we will not retroactively change fees or cancellation rules for a confirmed booking without your consent or as required by law and Supplier rules.
2. Services Description
We are a retail travel agency that books products from third parties—airlines, hotels, cruises, tours, rail, cars, insurers, and others (each a “Supplier”). We are an agent or intermediary, not the operator of those services, unless we say otherwise in writing. Website and proposal content is for general guidance; Supplier contracts, tariffs, tickets, and vouchers govern the actual services and are part of your purchase by reference. Itinerary times, aircraft types, amenities, and similar details are subject to change by Suppliers without notice to us.
3. Booking and Reservations
Bookings require availability, Supplier acceptance, and applicable fare rules. Confirmation occurs when we send written confirmation (including email) and required deposits or payments under Section 4 are applied. We may require non-refundable planning deposits; Supplier deposits follow Supplier rules. You must verify names, dates, times, locations, and fare classes promptly—changes after ticketing may be impossible or costly. Modifications depend on Supplier rules; we will assist using reasonable efforts but cannot guarantee approval. Our service fees may apply in addition to Supplier change or cancellation charges.
4. Pricing and Payment
Prices are in U.S. Dollars unless stated otherwise. Quotes expire as shown on the proposal or when repriced by the Supplier. Taxes, surcharges, fees, and exchange rates may change until paid in full and documents are issued. You authorize charges to your payment method for the invoice total, including our fees and taxes. Cards are processed by third parties; we do not retain full card data. Non-refundable service or ticketing fees, Supplier penalties, no-show charges, and chargeback costs may be billed as disclosed. Refunds follow Supplier rules and Section 5; processing can take multiple cycles, and we need not advance cash before the Supplier pays us unless agreed in writing.
5. Cancellation Policy
Supplier and carrier rules control if stricter. Non-refundable air, promos, insurance, and our non-refundable fees (per invoice) stay non-refundable regardless of timing. For the land and tour portion of our packages (not standalone airfare governed only by airline tariffs), unless your confirmation states a custom policy:
- 60+ days before departure: refund of recoverable Supplier amounts minus non-refundable deposits, Supplier penalties, and our non-refundable fees.
- 30–59 days: typically up to ~50% of the land package forfeiture, plus non-recoverable Supplier amounts and fees, unless the Supplier charges more.
- 15–29 days: typically up to ~75% forfeiture, plus non-recoverable amounts and fees, unless the Supplier charges more.
- Under 15 days or no-show: typically 100% non-refundable for affected services, plus Supplier penalties.
Cruises, groups, and charters may differ—follow your invoice and Supplier documents. Cancel by email to [email protected]; cancellation is effective when we acknowledge it and complete Supplier processing.
6. Travel Insurance
We recommend comprehensive insurance for cancellation, interruption, medical, evacuation, and baggage. Policies are issued by third parties; read terms, exclusions, and pre-existing rules before buying. Going without insurance is at your financial risk.
7. Traveler Responsibilities
- Documents: Valid passports (often 6+ months beyond return), visas, permits, and health certificates as required.
- Health: Follow medical and government guidance; you assume risk if you ignore advisories or entry rules.
- Conduct: Obey Supplier rules and local law; we may refuse service for abuse, fraud, or illegality.
- Timing: Arrive for check-in as directed; late arrival and missed connections are your responsibility absent our proven negligence.
8. Limitation of Liability
TO THE FULLEST EXTENT ALLOWED BY LAW, ADIGA TRAVEL AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS DISCLAIM INDIRECT, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES AND LOST PROFITS OR DATA ARISING FROM THE SERVICES OR THESE TERMS, REGARDLESS OF THEORY OF LIABILITY.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES OR THESE TERMS IS LIMITED TO FEES YOU PAID US FOR THE SPECIFIC BOOKING IN THE PRIOR TWELVE (12) MONTHS, OR $200 IF NONE—EXCEPT WHERE SUCH CAPS ARE VOID (E.G., GROSS NEGLIGENCE OR WILLFUL MISCONDUCT WHERE PROHIBITED). WE ARE NOT LIABLE FOR SUPPLIER ACTS OR FOR FORCE MAJEURE (WEATHER, PANDEMICS, WAR, STRIKES, GOVERNMENT ACTION, ETC.). REMEDIES AGAINST SUPPLIERS ARE UNDER THEIR CONTRACTS AND APPLICABLE TREATIES.
9. Intellectual Property
Site and proposal content (text, graphics, logos, itineraries) belongs to us or licensors and is protected by IP laws. No copying, scraping, or derivative use without written consent, except limited personal use for your trip. Third-party marks remain their owners’ property.
10. Governing Law; Venue
These Terms and related disputes are governed by the laws of the State of Washington, without regard to conflict-of-law rules. You consent to exclusive jurisdiction in state and federal courts in King County, Washington, except small claims or mandatory arbitration where applicable. Invalid provisions are severed. Before suing, contact us for thirty (30) days to seek informal resolution.
